Although the purchaser as this foreclosure sale bought the property for $1,000, a nominal amount, any deficiency judgment has been waived. Under the circumstances presented herein, there was no such inadequacy in price as to shock the conscience of the court in order to justify the vacation of the sale (State Realty & Mtge. Co. v. Villaume, 121 App. Div. 793). Moreover, we wish to note that in the case at bar the motion to confirm the sale was granted without opposition and no motion for a resale was made until appellant sought possession, eight months later. Disposition Order reversed, with $10 costs and disbursements, and motion denied.
